Earlier today, we published a report of an accusation that Cape May Brewing infringed on an existing trademark for their “Shore Tea” collaboration product with Pennsylvania based convenience store Wawa.

If you read the original report, the brewery was accused by Jeff Plate, former owner of Asbury Park Brewing, of having taken his idea for the “Shore Tea” concept. Mr. Plate alleges that he approached Cape May in May of 2022 with the idea of the product, even going as far as filing a trademark for the name.

The brewery released the following statement with regards to the situation:

“Any claims that the Peach Shore Tea product, name, branding or packaging were developed in imitation of anything from any third party are groundless. Cape May’s Peach Shore Tea collaboration with Wawa was a special release for the summer. Like all Cape May products, the recipe and look of Peach Shore Tea have been in development for more than six months, with the name and branding selected well in advance of their release to the public, in this case finalized in March 2022.”
